DZX STUDIO / LEGAL

Terms of Service

Scope of these terms

These terms govern use of the DZX STUDIO product website, documentation and tutorials. “DZX STUDIO”, “we” and “us” refer to the publisher of this website and the native Mac IDE for ZX Spectrum 48K and 128K.

You may use the website and its learning material subject to these terms and applicable law. If you do not agree to these terms, stop using the website.

A released application is governed by the software licence and distribution terms supplied with that release. These website terms do not grant a software licence, replace an open-source licence or create a purchase agreement.

Availability, downloads and product information

DZX STUDIO is available as DZX Studio Forge on the Mac App Store. Check the Download and Compatibility pages for system requirements and current limitations.

Experimental features may change or be removed. Roadmap items describe plans, not a commitment to deliver a particular feature or release date.

This website does not take payments, orders or subscriptions. Any future paid offering must present its applicable price, licence, payment and cancellation terms before purchase.

Permitted use

Use the website lawfully. Do not disrupt its operation, distribute malicious software through it, attempt unauthorised access to non-public systems or falsely claim an affiliation with DZX STUDIO.

You are responsible for ensuring that material you import, modify, distribute or send to another service can lawfully be used for that purpose. This includes source code, artwork, music, fonts and ROM images.

These terms do not restrict uses, exceptions or other rights protected by applicable law.

Your projects and responsibility for results

You retain any rights you hold in your source code, graphics, music and project files. Using DZX STUDIO does not transfer those rights to us, and we do not receive your project files through normal application use.

Review and test code, generated suggestions, compiled programs and exported media before relying on or distributing them. A successful build or emulator run is not a guarantee of correctness, compatibility with every machine or freedom from third-party rights.

Keep backups of important work. Software and experimental tools can contain errors, and examples may need adaptation to your project.

AI and other third-party services

AI features are optional. The service, model, account or local runtime you choose has its own terms, eligibility requirements, availability, charges and usage limits. An integration in the IDE does not include a paid provider subscription or credit.

Providers such as OpenAI, Anthropic and OpenRouter may process the content and technical information sent to them. The Privacy Policy explains these flows separately from DZX STUDIO’s no-collection approach.

AI output can be inaccurate, incomplete or unsuitable. Review proposed changes before applying them and check the result and any licensing requirements. We do not guarantee another provider’s service, output, pricing or data-retention practices.

References or links to another product do not imply affiliation or endorsement. Using external services remains subject to their applicable terms.

Website content and third-party rights

Branding, website content and third-party components remain subject to their respective owners’ rights. Unless an applicable licence or law permits it, browsing the site does not grant permission to redistribute its branding, software or artwork.

The ZX Spectrum photograph by Bill Bertram is used under CC BY-SA 2.5. The site includes a background-removed version and a Spectrum-palette conversion shown in the Graphic Editor. That licence governs reuse of the photograph and its adaptations.

ZX Spectrum and other third-party names identify the platforms or services discussed. Open-source and other third-party licences continue to apply and are not overridden by these terms.

Limitations and statutory rights

The website, documentation and examples are provided as available. Information may require correction, and the website or external links may sometimes be unavailable. Except for commitments expressly given in an applicable licence or purchase agreement, we do not promise uninterrupted access or that the material will satisfy every purpose.

Nothing in these terms excludes or limits liability, consumer protection or other rights where doing so would be unlawful. Mandatory legal protections and rights under an applicable software licence or purchase agreement remain unaffected.

These website terms do not impose an exclusive court, mandatory arbitration or a waiver of statutory remedies.

Publisher information and changes

For questions about DZX STUDIO, these terms or this privacy policy, contact netkomm@gmail.com. Publisher information is available at NelloCastellano.com, the developer website linked from the application.

We may update these terms to reflect changes to the website or applicable requirements. The date at the top identifies the current version. Changes do not retrospectively alter a completed purchase or override any consent required by law.

Our Privacy Policy describes local storage and third-party processing. These terms do not authorise the collection of user data or the transmission of a project to an AI service.
